Active Litigation re Pyrolysis Oil Production Elsewhere in the U.S.
There is active litigation over the production of pyrolysis oil. Litigants assert that it is an incredibly toxic material with the EPA estimating its risk to be 250,000 in a million when burned as fuel. The Toxic Substance Control Act was examined regarding the regulation of this waste. So far, the EPA has refused to release the actual chemical composition of pyrolysis oil. Environmentalists indicate that much of the hazardous waste produced in California does not have a 250,000 in a million risk, but this waste stream from the pyrolysis of plastic does. Many of the existing pyrolysis facilities cannot find a market for this waste so it gets stockpiled on site and eventually disposed of as hazardous waste where it is incinerated.
Attached are the comments produced by environmentalist groups on the TSCA rulemaking process. It contains information re health hazards associated with pyrolysis oil as it affected a local community.
